SERVICE AGREEMENT

This Service Agreement ("Agreement") is entered into by Daniele Carta Mantiglia, registered as a sole trader under HMRC as Daniele Alan Carter, UTR 3725094417 (hereinafter referred to as "Coach"), operating under the trade name THE ARTIST CIRCLE, and the undersigned individual (hereinafter referred to as "Student").

By purchasing a package of sessions from THE ARTIST CIRCLE, the Student agrees to the terms and conditions below.

1. Non-Refundable Policy

• All session packages, including but not limited to the 6-hour and 12-hour packages, are non-refundable once purchased.

2. Package Expiration

• Each package of sessions is valid for a maximum period of three (3) months from the date of the first session. After this period, any unused sessions will be forfeited. This timeframe may be adjusted (shortened or extended) if otherwise specified and agreed upon during the confirmation session following the Discovery Call, in accordance with the coach’s recommendations and the student’s acceptance of the proposed plan.

• It is the Student’s responsibility to schedule and complete all sessions within this 3-month period.

3. Extension of Package Period

• The only conditions under which the package period can be extended are as follows:

  • Student-Requested Extensions: To request an extension, the Student must email info@artistcircle.co.uk at least 30 days prior to the end of the package period, detailing the reason for the absence. An extension request is not automatically granted. The Coach will respond by email with a decision, including any updated end date if an extension is approved. This response email will serve as a legally binding document confirming the new expiration date.

  • Coach/Studio Unavailability: If the Coach or the ARTIST CIRCLE studio is temporarily unavailable to provide sessions, the package period will be automatically extended to accommodate the period of unavailability. The new expiration date will be communicated by the Coach via email.

4. Student Responsibility to Communicate Scheduling Issues

• Students are responsible for promptly communicating any issues they encounter when attempting to schedule sessions.

• If available time slots do not match the Student’s personal schedule, it is the Student’s duty to notify the Coach in a timely manner. Failure to communicate such issues will result in the week being deemed as used, and the session will not be refunded or rescheduled.

• Students may book a missed session later within the 3-month period, potentially booking two sessions in one week if necessary, provided the sessions are scheduled and completed within the package's valid period.

5. Rescheduling Policy

• Standard Rescheduling: Rescheduling is available through the Student’s personal login portal and can only be made 48 hours or more before the scheduled session.

• Urgent Rescheduling: For urgent matters, a reschedule may be requested up to 24 hours before the session by contacting the Coach directly via WhatsApp or email. The request must include the reason for the reschedule. Approval of urgent rescheduling is at the sole discretion of THE ARTISTI CIRCLE and The Coach, based on the validity of the provided reason.

• Rebooking of Rescheduled Sessions: If a reschedule is granted, the session must be rebooked within the available time slots provided by THE ARTIST CIRCLE. If the Student cannot attend any of the provided time slots, the session will be forfeited.

6. Missed Sessions

• If a session is canceled or missed by the Student with less than 24 hours' notice, or if the Student does not show up without prior notice or an approved reschedule, that session will be forfeited.

• Rescheduling is subject to the Coach's availability and must be done within the valid package period.

7. No Warranty or Guarantee of Outcomes

• The Coach makes no guarantees regarding any specific outcomes from the sessions. Results depend on the Student's commitment, participation, and practice.

8. Entire Agreement

• This Agreement constitutes the entire agreement between the parties and supersedes any prior agreements or understandings, whether written or oral.

• This Agreement may only be amended or modified in writing, with the sole exception of the duration of the package, which is determined during the recorded Discovery Session and confirmed via email. The confirmation email shall form an integral part of the terms accepted under this Agreement.

9. Governing Law

• This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which The Artist Circle and Daniele Carta Mantiglia (also known as Daniele Alan-Carter) operate.

• By signing below, the Student acknowledges that they have read, understood, and agreed to all the terms and conditions set forth in this Agreement.
